II - GENERAL CONDITIONS OF USE

 

  1. Purpose of the Site

 

The PARFETIQUE website (hereinafter the "Site") is an e-commerce site that offers perfumes of different brands for sale to Internet users or users browsing the Site (hereinafter the "Visitor(s)"). This Site is accessible via the Internet at the address www.jeroboamparis.com;

PARFETIQUE collects personal data within the framework of this Site.

 

To learn more about PARFETIQUE's practices regarding the collection, use and communication of personal data as well as the provisions relating to the exercise of rights, Visitors are invited to consult the "Personal Data & Cookies" policy of this Site.

3.1. Site


The Site and any software necessarily used in connection with it may contain confidential information as well as data protected by intellectual property law. Thus, unless otherwise stated, the intellectual property rights on the documents and any data of any nature contained in the Site and each of the elements making up the Site (images, illustrations, sounds, texts, graphic elements, charter, etc.), including software, databases and newsletters are the exclusive property of PARFETIQUE (hereinafter the "Content"), which does not grant any license or any right other than that of consulting the Site. The reproduction of all or part of the Content is only authorized for the exclusive purposes of information for personal and private use, any reproduction and any use of copies made for other purposes in any manner and in any form being expressly prohibited. It is also prohibited to copy, modify, create a derivative work, assemble, decompile (except in cases provided for by law), sell, assign, sublicense or transfer in any way any right relating to the Content. It is also prohibited to modify all or part of the Content and in particular the software or to use modified versions of the software in order to obtain unauthorized access to the service and to access the Site by any means other than the interface which is provided to the Visitor by PARFETIQUE for this purpose.

Please note that the company PARFETIQUE owns the JEROBOAM PARIS brand and its logos.

The Visitor acknowledges PARFETQUE's exclusive rights to the JEROBOAM PARIS brand and agrees not to make any use of it and, more generally, to infringe PARFETIQUE's intellectual property rights. PARFERIQUE reserves the right to claim damages in the event of counterfeiting and, more generally, infringement of its intellectual property rights.


All other trademarks or logos appearing on the Site are the property of either PARFETIQUE or its service providers, partners or suppliers. Any use, in any manner whatsoever, of these trademarks and/or logos and/or any other Content is subject to the express prior authorization of PARFETIQUE or the holder of the intellectual property rights concerned.


3.3. Hyperlinks


The Site may include links to other websites or other Internet sources. To the extent that PARFETIQUE cannot control these external sites and sources, PARFETIQUE cannot be held responsible for the provision of these external sites and sources, and cannot bear any responsibility for the content, advertisements, products, services or any other information or data available on or from these external sites or sources. Furthermore, PARFETIQUE cannot be held responsible for any proven or alleged damage or loss resulting from or in connection with the use of or having trusted the content, goods or services available on these external sites or sources.


Any creation of links to the PARFETIQUE Site, any framing of the Site, and more generally any use of an element composing the Site, is subject to the prior and express authorization of PARFETIQUE which may be revoked at any time at its sole discretion. PARFETIQUE reserves the right to (i) request the removal of any link to the Site that has not been, or is no longer, authorized and to (ii) request damages in compensation for the harm suffered as a result.

 

  1. Visitor Behavior

 

Each Visitor must use the Internet responsibly with respect and courtesy towards the rights of other Internet users.


As such, the Visitor, when accessing the Site, undertakes in particular not to:


- upload to the Site, post, email or otherwise transmit any content that is unlawful, harmful, threatening, abusive, harassing, tortious,

 

defamatory, vulgar, obscene, contrary to good morals, infringing on a person's privacy, including their right to image, hateful or derogatory or shocking from a racial, ethnic or other point of view;


- upload to the Site, post, email or otherwise transmit any unsolicited or unauthorized advertising or promotional materials, "junk mail", "deceptive marketing", "chain letters", or any other form of solicitation;


- upload to the Site, post, email or otherwise transmit any material that contains software viruses or other computer codes, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;


- disrupt or interrupt the Site or servers or networks connected to the Site, or violate any requirements, procedures, rules or regulations of networks connected to the Site;


- attempt to damage service to any user, host or network, including, without limitation, submitting a virus to the Site, overloading, flooding the server, spamming the email system or forging any TCP/IP packet header or any part of the header information contained in any email;


- access data not intended for the Visitor or enter a server/account to which the Visitor is not authorized to access;


- attempt to probe, scan or test the vulnerability of a system or network, or otherwise breach security or authentication measures without authorization;


- impersonate another person;


- carry out an activity or incite a third party to carry out an illegal activity or any other activity which would infringe the rights of PARFERIQUE, its suppliers, partners, distributors, its advertisers or any other Visitor;


- transmit or transfer (by any means whatsoever) information or software derived from the Site, in particular to other countries or to certain foreign nationals in violation of a national or international law or regulation.


Recognizing the global nature of the Internet, each Visitor agrees to comply with all local and international rules and procedures relating to online behavior and acceptable content, including all applicable laws regarding the transmission of technical data.


At any time and for any reason whatsoever, PARFETIQUE may implement any means to terminate, without notice, the Visitor's use of the Site or any of PARFETIQUE's services for any conduct violating these conditions of use, without prejudice to any damages that PARFETIQUE reserves the right to claim from the Visitor in the event of non-compliance with these general conditions of use of the Site.

 

 

  1. Responsibility


5.1. Access and operation of the Site

The Visitor is personally responsible for setting up the IT and telecommunications resources enabling access to the Site and for the knowledge necessary for using the Internet and accessing the Site. The Visitor shall bear the connection and equipment costs associated with accessing the Internet and using the Site.


The Visitor uses the Site at his own risk. PARFETIQUE cannot therefore be held responsible for any damage that any Visitor may suffer as a result of such use.

 

Furthermore, PARFETIQUE declines all responsibility for indirect damages, whatever the causes, origins, nature or consequences, including in particular the costs that may arise from the acquisition of goods, in particular the costs that may arise from the acquisition of goods offered on the site, loss of profits, customer data or any other loss of intangible property that may arise due to anyone's access to the site or the impossibility of accessing it or the credit given to any information coming directly or indirectly from the latter.


5.2. Limitation of liability


The Site also contains information from third parties, and links to other websites. PARFETIQUE does not control the accuracy of the information found there or its content. Consequently, PARFETIQUE cannot be held responsible for any damage resulting from the use of, access to, or inability to use this third-party information, or the content of other websites.

PARFETIQUE cannot be held responsible for any guarantee of any kind, whether implicit or explicit, concerning in particular the integrity, accuracy, timeliness, non-infringement, availability, reliability or exhaustiveness of the information, products, accessories or services appearing on the Site nor their suitability for the use that the Visitor plans to make of them.


Any claim filed by a Visitor against PARFETIQUE must be made within six (6) months following the occurrence of the event which is the subject of the claim.

 

  1. General


6.1. Modifications


PARFETIQUE reserves the right to modify and update the General Terms of Use without notice. To be informed of these possible modifications, PARFETIQUE advises the Visitor to reread the T&Cs regularly. Use of the Site will be subject to the T&Cs in force at the time of use.

6.2. Entirety


In the event that one of the clauses of these T&Cs is void due to a change in legislation, regulations or a court decision, this shall in no way affect the validity and compliance with the other clauses of the T&Cs.


6.3. Applicable law


These T&Cs are subject to French law.


Any dispute relating to the existence, interpretation, execution or termination of the contract concluded between PARFETIQUE and the Visitor, even in the event of multiple defendants, will, in the absence of an amicable agreement, be under the exclusive jurisdiction of the Courts of Paris. This attribution of jurisdiction is valid notwithstanding multiple defendants or third-party claims, even for emergency procedures or interim relief proceedings in summary proceedings or by petition.
