General conditions of sale
PREAMBLE
Unless otherwise specified, these General Terms and Conditions of Sale and the Legal Notice below are applicable to all browsing on the website www.jeroboamparis.com (hereinafter referred to as the "Site").
This Site means all the pages and/or sites accessible at this address, including the versions optimised for navigation via mobile or tablet.
It should be noted that these General Terms and Conditions of Sale, as well as the Legal Notice below, may differ depending on the country and/or region and/or country of departure of the products concerned.
The company PARFETIQUE (hereinafter referred to as the "Seller") sells perfume products (hereinafter referred to as the "Products" or the "Product") presented on its website only at retail and for strictly personal use, to end consumers (hereinafter referred to as the "Consumers" or the "Consumer").
Any order which clearly does not correspond to a retail sale or, more generally, any fraudulent order or presumed to be such will be considered by PARFETIQUE as null and void.
For the purposes of these Terms and Conditions, it is agreed that the Consumer and PARFETIQUE will be collectively referred to as the "Parties" and individually referred to as the "Party".
By placing an order for a Product on the Site, the Consumer acknowledges having read these General Terms and Conditions of Sale and having accepted them without restriction. This acceptance is in no way conditioned by a handwritten signature from the Consumer.
It is specified that the Consumer may save or print these General Terms and Conditions of Sale, provided that they are not modified. The Seller reserves the right to update its General Terms and Conditions of Sale at any time, it being specified that the General Terms and Conditions of Sale applicable shall be those in force at the date of the order.
Finally, the JEROBOAM PARIS online shop is available in French and English. The Consumer acknowledges that the translation of the online shop into English is only offered for his convenience and that the language chosen by the Consumer may be different from the language used by the Seller, which depends in particular on the location of the delivery address indicated by the Consumer.
Consumers' access to the Site is also governed by General Conditions of Use of the Site, which they accept without reservation.
ARTICLE 1: PURPOSE
The purpose of these general terms and conditions of sale (hereinafter referred to as the "GTC") is to define the terms and conditions of online sale by the Seller of Products to the Consumer, as well as the rights and obligations of the Parties arising from the online sale of products offered on the Site (hereinafter referred to as the "Product(s)").
They determine all the steps necessary for the placing of the order and ensure the follow-up of this order between the Parties and apply, without restriction or reserve, to all the Products offered by the Seller on its Site.
ARTICLE 2: THE PRODUCTS
2.1 Description of the Products
The Products offered for sale by the Seller are those listed on the Site on the day of its consultation by the Consumer of the Site, and within the limits of available stocks.
PARFETIQUE reserves the right to withdraw the Products from sale at any time.
PARFETIQUE presents on the Site the Products for sale as well as their detailed descriptions in product sheets. The Products are described with the greatest possible care and accuracy. Nevertheless, the photographs and/or visuals on the Site are only indicative and are not contractual.
For any question relating to a Product or its use, it is therefore recommended to contact the Seller's customer service department, using the contact details provided in the following articles.
The Products comply with the French legislation in force. The Seller shall not be held liable in the event of non-compliance with the legislation of the country to which the Product is to be delivered. It is therefore up to the Consumer to check with the local authorities the possibilities of importing and/or using the Products he/she intends to order.
The Products are presented within the limits of available stocks and the Seller cannot guarantee the availability of the Products advertised on the Site.
At any time, PARFETIQUE reserves the right to modify or discontinue the sale of Products offered on the Site. However, such modifications shall not affect orders accepted by PARFETIQUE prior to the entry into force of such modifications.
In any case, in the event of total or partial unavailability of the Products after the order has been placed, the Consumer will be informed as soon as possible, by any means, of the unavailability of the Product and of the total or partial cancellation of the order.
In case of total cancellation :
- The Consumer's order will be automatically cancelled and his bank account will not be debited;
- The Consumer will be informed by any means.
In case of partial cancellation :
- The Consumer's order will only be partially validated and his bank account will only be debited with the amounts corresponding to the available Products:
- The rest of the order will be cancelled;
- The Consumer will be delivered the available products.
In any case, if the Consumer's order was eligible for free delivery, the fact that the minimum rate is no longer reached does not deprive the Consumer of this free delivery.
Article 3 : Prices
3.1 All prices are indicated in Euros (EUR). The applicable prices are those indicated on the Site at the time the Consumer places his/her order. These prices do not include certain additional costs such as transport costs and duties, which will be charged in addition. The Consumer may also be required to pay mandatory taxes and duties as well as any bank charges, which will always be at their expense (for France, prices are indicated inclusive of VAT).
3.2 At any time, PARFETIQUE reserves the right to modify its prices, without any further formality other than posting the modifications on the Site. However, such changes will not affect orders accepted by PARFETIQUE before the changes come into effect, subject to the availability of the Products ordered.
3.3 These prices do not include shipping costs, which are invoiced to the Consumer in addition to the price of the Products purchased. The shipping costs will be indicated before the Consumer places the order.
Furthermore, the prices announced on the Site do not take into account customs duties and other costs that may be associated with the import of the Products.
PARFETIQUE therefore advises Consumers to contact the local authorities to obtain, in addition, import taxes and duties.
3.4 Prices include Value Added Tax (VAT).
Sales eligible for VAT refunds must be made in-store.
3.5 The various shipping methods are set out in Article 6 below and are recalled on the Site; they may be modified at any time by PARFETIQUE. The Seller therefore advises Consumers to regularly consult the GTC available on the Site.
ARTICLE 4: ORDER
4.1 Ordering
By browsing the Site, the Consumer has the opportunity to view the Products offered for sale on the day of visiting the Website. Browsing the various pages of the Website does not commit the Consumer to placing an order.
During his navigation, the Consumer who wish to place an order may do so by following these steps:
- Fill your virtual basket by clicking on the "Add to basket" icon, which appears next to each product viewed.
Once this operation has been completed, the Consumer will see a message confirming that the item has been added to the basket, and the number of items in the basket will be displayed at the top right of the screen.
- Continue browsing by clicking on "Continue shopping" or click on "Checkout" to view the items in the order, including the total amount (excluding shipping costs), the nature of products ordered and their quantity.
The Consumer may return to this order, complete it, modify it, or cancel it as long as it has not been confirmed. If the Consumer wishes to select other Product(s), they simply need to click on "Continue shopping", ensuring that the Product(s) they have just selected is/arestill in the "Order" section.
- If the customer has a discount code, they can enter it in his virtual basket. The total amount of the order will then be automatically recalculated.
- Once the selection of Products is complete, the Consumer can validate the order by clicking on "Place order".
A new web page will then open inviting the Consumer to :
- i) login with email and password to order using their customer account, or
- ii) place an order by creating a customer account.
The Consumer must then provide their contact details, by accurately completing the form provided. They undertake to provide an address where delivery can be made during business hours, as well as their first name(s) and e-mail address.
For all order delivered outside the European Union, the price shall necessarily be exclusive of tax.
The Consumer may refer to PARFETIQUE's "Privacy Policy" for more details on how PARFETIQUE collects and processes personal data, PARFETIQUE cannot be held liable for any inaccuracy in the information provided by the Consumer.
- Finally, the Consumer will have to choose the type of delivery desired (home delivery) and the method of payment (bank cards, PayPal, Alma...). At the bottom of this same page, an order summary will list all the information relating to this order, including the nature, quantity and price of the Products and the total amount of the order (including shipping costs).
- After reviewing the status of their order, the Consumer will be asked to:
- Either click on the "Confirm order" button to proceed with the payment of their order, in accordance with the provisions of article 4 of these T&Cs;
- Or click on the "Order" button in navigation module at the top left to modify the characteristics of their order and/or their personal details;
- By continuing, the Consumer must first read the GTC and then tick the box next to the message "I have read the general terms and conditions of sale and accept them without reservation".
Once these GTC have been accepted and the order confirmed, a payment page will open.
- The Consumer must then pay for their order using one of the payment methods offered by PARFETIQUE.
It is hereby reiterated that purchases made on the Website are reserved for private, non-professional customers for their own use, which is why PARFETIQUE only sells its products in quantities corresponding to the average needs of a household. In accordance with Article L121-11 of the French Consumer Code, PARFETIQUE reserves the right to refuse or cancel, for legitimate reasons, any order for which the number of products or the amount payable (for a single order or several cumulative orders) does not correspond to the average usual use of a household, any order that suggests that the buyer is carrying out an economic activity in connection with the products ordered or, more generally, any abnormal order within the meaning of the applicable case law.
PARFETIQUE shall in no event be held liable for the unavailability of the Website at the time of the order, for any reason whatsoever.
4.2 Order confirmation
4.2.1. Formation of the sale
Once the order has been confirmed and payment validated in accordance with the terms and conditions set out in article 5 below (in the case of payment by bank card, provision of the bank card number, its expiry date and, where applicable, the visual cryptogram), a printable and recordable summary of the Consumer's order will be displayed, mentioning, in particular, the references of the order.
At this stage, the Consumer will not be able to modify his order.
Following validation of the payment by the Consumer, the latter will receive an order confirmation e-mail sent by PARFETIQUE. This will contain the following information:
- Order number ;
- summary of the order ;
- Amount of the order, all taxes included ;
- Shipping costs ;
- Confirmation of payment;
- Procedures for exercising the right of withdrawal, in accordance with the provisions of Articles L121-20 of the French Consumer Code;

Only the receipt by the consumer of the e-mail confirming the order forms the sales contract.
4.2.2. Retention of title
PARFETIQUE retains full and complete ownership of the Product(s) ordered until full payment of the principal amount, including costs, taxes and mandatory contributions has been received.
4.2.3. Refusal/cancellation oforder
In order to protect PARFETIQUE from abusive or fraudulent practices, or practices that do not comply with the distribution networks that it has set up, in the event that PARFETIQUE suspects one of these practices when placing an order, it reserves the right to ask the Consumer for additional documents (proof of residence and debit in the Consumer's name, photocopy of the Consumer's identity card, photocopy of the Consumer's bank card, or other).
PARFETIQUE also reserves the right to refuse or cancel an order for a legitimate reason, including, but not limited to, when:
• the Consumer was able to place an order when the product(s) ordered had become unavailable in the meantime.
• a technical error occurs during the consumer's payment;
• there is an obvious error in the product description (for example, when there is an error in the essential characteristics of the product, or when a clearly incorrect price is displayed);
• PARFETIQUE detects or suspects fraudulent or abusive use of the customer account and/or related orders;
• PARFETIQUE suspects a breach of these T&Cs.
In this case, PARFETIQUE undertakes to inform the Consumer as soon as possible and to refund them as soon as possible.
Finally, in the absence of a response from the Consumer within fifteen (15) days of the request being sent by PARFETIQUE or for any other legitimate reason, the order will be automatically cancelled and PARFETIQUE will proceed as soon as possible to refund the order to the bank account debited at the time of the order.
4.3 Proof of order
In general, e-mails shall be deemed authentic between the Parties, in the same way as the automatic registration systems on the Site, particularly as regards the nature of the order.
The computerised records kept in the computer systems of PARFETIQUE and its partners will be considered as proof of communications, orders and payments between the Parties.
The Consumer may access the electronic contract concluded between the Consumer and PARFETIQUE at any time, in accordance with the rules of common law. To do so, The Consumer shall contact the Consumer Service via the "contact" tab or by e-mail to contact@jeroboamparis.com, providing all the necessary information, in particular the order number and their contact details.
ARTICLE 5: PAYMENT

The credit card is debited at the time of shipment of the order.
Any bank charges remain the responsibility of the Consumer.
Accepted credit cards include: Credit card, Visa, and Master Card. The credit card is charged at the time of the order shipment.
In general, the Consumer guarantees PARFETIQUE that they have the necessary authorisations to use the chosen method of payment at the time of order confirmation. If the bank refuses payment, the order will be automatically cancelled.
PARFETIQUE uses the Payplug payment platform.
5.2. PARFETIQUE also reserves the right to refuse any order or any delivery which may appear abnormal, in the event of an existing dispute with the Consumer, or even, but not exclusively, of total or partial non-payment of a previous order by the Consumer.
5.3 Penalties of an amount equal to the legal interest rate may, at PARFETIQUE's discretion, be applied automatically to amounts outstanding at the end of a period of ten (10) days following the date of the Order or upon notification of the rejection of bank payment.
5.4 Payment in installments with Alma
Payment in instalments/deferred payment is available through our partner Alma for the following countries: France, Spain, Portugal, Germany, Italy, Belgium, the Netherlands, Luxembourg, Austria and Ireland.

ARTICLE 6: DELIVERY
6.1. Delivery
When the Consumer is eligible for delivery, PARFETIQUE delivers to many countries listed at the following address: https://www.jeroboamparis.com/pages/zones-et-delais-de-livraison
The Consumer may track the progress of their delivery on the Website by clicking on their customer account.
As delivery is provided by a third-party service provider, PARFETIQUE cannot be held liable if the non-performance or poor performance of this obligation is attributable to the Consumer, to the unforeseeable or insurmountable actions of a third party to the contract or to a case of force majeure.
The Consumer shall also bear the consequences (delayed delivery, inability to deliver, return of the Products to PARFETIQUE, additional transport costs) resulting, where applicable, from the incorrect and/or incomplete information provided by them for delivery and/or the absence of the Consumer at the time of delivery.
6.2. Deadlines
The Products will be delivered by the usual postal services or by carriers whose average delivery times are available on the DELIVERY page.
Sundays and french public holidays are not considered as working days.
In any case, the order will be executed within a maximum of thirty (30) days from the day following the day on which the Consumer has transmitted his order, subject to full payment of the price.
6.3. Delay in delivery
If the maximum delivery time of thirty (30) days is exceeded and if the Product(s) ordered have not yet been shipped, and if this is not due to a case of force majeure, the Consumer may cancel the order by registered letter with acknowledgement of receipt sent to the following address :
PARFETIQUE SARL
Internet Ordering Service
26 rue de Wolfenbuttel
92310 Sèvres
FRANCE
From the date of receipt of the Consumer's letter and if delivery has not taken place in the meantime, PARFETIQUE will reimburse the bank account debited at the time of the order, as soon as possible, to the exclusion of any other compensation.
In the event of partial delivery, the delivery could be carried out in several times, and the Consumer will be able to cancel his order only for the undelivered balance.
Any delay in delivery must be reported as soon as possible by the Consumer by e-mail to contact@jeroboamparis.com, so that PARFETIQUE can carry out an investigation with the postal services or the carrier. The Consumer must be informed that the time taken to carry out an enquiry is random, as PARFETIQUE has no control over its execution. If during this investigation the parcel is found, it will be immediately redirected to the place of delivery designated in the Consumer's order.
Nevertheless, if at the end of this investigation it is confirmed that the package containing the Product(s) has been lost, PARFETIQUE will, at its own expense, reship the Product(s) to the Consumer or, in the event of definitive unavailability, reimburse the Consumer for the sums received, to the bank account debited at the time of the order, in accordance with the terms of these general conditions of sale.
6.4. Delivery made
Each delivery is deemed to have been made as soon as the Product(s) are made available to the Consumer by the carrier, as evidenced by the control system used by the carrier, such as the delivery tracking system.
In accordance with the applicable provisions of the Consumer Code, the Consumer will receive, at the time of delivery, an invoice detailing the price of the products ordered and, where applicable, the delivery costs charged to him/her, as well as a return form enabling him/her to exercise his/her right of withdrawal and obtain reimbursement of the products or to exchange them.
It is the Consumer's responsibility to verify immediately upon receipt of the Product(s) the conformity and integrity of the Product(s) shipped.
In the event of delay, breakage or lack, the Consumer will have to emit on the delivery order of the complete and precise reserves. In any case, the Consumer can only exercise his recourse against the carrier to whom he must formulate his reserves. Any reservations must be confirmed by registered letter to the carrier within three (3) working days following receipt, specifying the package number, the reasons for the complaint and enclosing, if applicable, a copy of the delivery note for the package.
Any reservation of this type must also be notified to the Consumer Service of the company PARFETIQUE within the same period and in the same form at the following address

In the event of non-conformity, the Consumer must inform PARFETIQUE at the above address, and return the products to the address indicated and under the conditions set out in Article 7.
6.5 Customs duties
Customs duties and additional customs clearance costs (processing fees, local taxes) are the sole responsibility of the Consumer or the recipient of the order, in addition to the order amount and delivery costs. They are entirely the responsibility of the Consumer, both in terms of declaration and payment to the relevant authorities and bodies in their country.
As these charges may vary depending on the country of delivery, PARFETIQUE invites the Consumer to check these aspects with the local authorities prior to placing any order.
In the event of refusal by the Consumer or the recipient to pay customs duties and/or additional customs clearance costs, no returns can be made. The costs of destruction shall be borne by the Consumer and no refund will be made.
ARTICLE 7: RIGHT OF WITHDRAWAL
7.1 Withdrawal period
The Consumer has a legal period of fourteen (14) clear days from the date of receipt or withdrawal of the products to exercise his right of withdrawal and request an exchange or refund of all or part of his order without having to give reasons or pay penalties.
If this period of fourteen (14) clear days expires on a Saturday, Sunday or french public holiday, it is extended until the next working day.
The Consumer who has exercised his right of withdrawal must return the product(s) within the above-mentioned period, in its (their) original packaging in good condition.
The Product(s) must be returned in its (their) original unopened packaging and in a condition suitable for resale.
Failing that, the Seller reserves the right to refuse to exchange or refund the product(s).
According to Article L221-28 of the Consumer Code, the right of withdrawal cannot be exercised, unless the parties have agreed otherwise, for contracts for the supply of goods made to the consumer's specifications or clearly personalised.
The attention of the Consumer is thus drawn to the fact that the right of withdrawal is not applicable to sales of products personalised at his request.

Upon receipt of the parcel, PARFETIQUE will judge the perfect condition of the returned goods and will send, if necessary, a confirmation email.
After this period, PARFETIQUE reserves the right to refuse the return or exchange requested by the Consumer.
No return or exchange will be accepted if the returned products have been visibly used or damaged by the Consumer and/or a third party and this use or damage makes the products unfit for sale.
In addition, the Consumer has a period of thirty (30) working days from the date of deposit of his package to make any claim relating to the return of the said package. No dispute will be accepted at the end of this period.
The Consumer must imperatively transmit his complaint by registered letter with acknowledgement of receipt sent to the following address

In case of return by another means than those proposed by PARFETIQUE, the parcel will be sent to the above address.
7.3 Refunds
In the event of a request for reimbursement, PARFETIQUE undertakes to reimburse the Products in accordance with the article L 221-24 of the French Code de la Consommation, by crediting the Consumer's bank account corresponding to the bank card used for payment, by bank transfer to the account whose details will be communicated to PARFETIQUE by the Consumer, or via PayPal.

In the case provided for in Article 1642-1, the action must be brought, on pain of foreclosure, within one year from the date on which the seller may be relieved of the defects or apparent lack of conformity.»
These legal guarantees apply independently of any commercial guarantee.
It is furthermore specified that the legal guarantees do not apply to normal wear and tear of the Products, in case of failure to follow the maintenance advice and to damage caused by causes external to the Products.
Similarly, PARFETIQUE cannot be held responsible for the misuse and/or intensive use of the products by the Consumer.
